In Connecticut, the age of consent to sexual intercourse is 16. However, the laws go on to state that a partner must be no more than three years older if the other participant is under the age of 16. Even though the sex may be consensual between a girl who is 15 years old and a boy who is 18 years and one month old, this is considered a criminal act. The older boy is the one who may be charged with a statutory sex offense and facing jail and potential sex offender registration.

Statute of Limitations in Sex Crime Cases

It is important to note that the statute of limitations in sex crime cases can vary due to the age of the alleged complaining witness at the time of the crime.

  • If the complainant was a minor at the time of the crime, criminal charges can be filed for up to 30 years after the person becomes a legal adult.
  • If the complainant was a legal adult at the time of the crime, criminal charges must be filed within five years of the alleged criminal act unless there is DNA which extends the statute of limitations when the accused is not known to the complainant.

This means that if an underage individual consented to sex but was a minor at the time, charges may be filed for up to thirty years after they reach the age of majority. That is a lifetime of wondering if or when charges may or may not be filed against you.
